The 60th Civil Affairs Division of the Seoul Central District Court, which was in charge of the objection, judged on the grounds that the "unfair purpose"to inflict damage to others has been explained, that the requirements for the "Unfair Competition Prevention Act" have been explained, the possibility of misunderstanding and confusion, and the fact that the recognition of the existing Korea Technology's business mark is recognized. The decision was made by the Korea Technology Group to make an injunction stating that the company name should no longer be used in the auto parts business.
"As there is a possibility of misunderstanding and confusion by consumers as much of it overlaps with the manufacturing and sales of automobiles, it is necessary to call for a ban on mutual use and prevention of violations of the manufacturing and sales of auto parts," the court said.
However, as the Korea Technology Group continues to use the company name, Korea Technology has filed criminal charges against Cho Hyun-beom and Cho Hyun-sik in protest. In May, it submitted an 'indirect application for coercion'to the court to order a certain amount of payment per day on the date of violation of use.
Korea Technology was established as 'Vision Telecom' in 1997, listed on the KOSDAQ market in 2001, and has been using the company name since March 2012.
