The Seoul Central District Court's Criminal 18 (judgment judge, Park Sang-gu) acquitted Lee Jae-woong, CEO of Socar, who was indicted on Thursday for violating the Passenger Car Transport Business Act. Also, Park Jae-wook, the CEO of Socar subsidiary VCNC who was handed over to the trial on the same charge, also sentenced him to not guilty.
Tada is a service that uses it as a smartphone application (app) to call an 11-seater van, including a driver. The prosecution has accused the corporation and its representatives of illegal call taxi sales of "TADA" and "SOCAR".
The issue of Tada is whether it violates the current law, and the current law prohibits the transportation of cars or the placement of cars, but 11 to 15-seater vans allow drivers to rent.
The prosecution and Tada interpreted the law differently, and the court ruled that Tada's claim was valid.
The court said, "Tada is a rental car service using a smartphone that users order at the time they need without driving directly."
Companies welcomed the court ruling.
“This ruling is aimed at continuing the challenge to new industries such as mobility,” the Venture Business Association said. “It will be an opportunity to provide people with better transportation benefits.”
Politics also welcomed the verdict, and some say that the law should be amended.
“This ruling is judged by the government’s irresponsibility and the prosecution’s unreasonable prosecution to survive the innovation industry,” said Chae Yi-bae, a lawmaker of the Baeunmirae Party. “We propose that we review the Tada Ban Act, which is currently being discussed at the National Assembly, from the beginning,” he said.
“The National Assembly should not pass the Tada Ban Act to fulfill its social responsibilities at this extraordinary session of the National Assembly,” said Chae Yi-bae, a member of the National Assembly. “We hope that discussions will be held to determine whether the future is a desirable direction to prepare for the future.”
