Wemade, Wins copyright infringement lawsuit for the Chinese game 'Mir 2'

[Infostock Daily= Reporter Park Sang-In] Wemade won a lawsuit against China's Chengchi Games (former Shanda Games) and 37 Games on the 14th to ban the service of web games 'Geon-gi-se-gye' and 'Geum-jang-geon-gi'.

Wemade filed a lawsuit with the Beijing Intellectual Property Court in October and November 2017, respectively, to ban the service on the grounds that Geon-gi-se-gye and Geum-jang-geon-gi are not only infringing on copyright but also using the prominent value of 'The Legend of Mir2(Chinese name: Yeol-hyeol-jeon-gi)' without due consideration.

The Beijing Intellectual Property Court accepted Wemade's opinion and decided to suspend the service of Geon-gi-se-gye and Geum-jang-geon-gi, which were not licensed by The Legend of Mir2, as copyright infringement and unfair competition.

During the trial, both games protested that they received the Geon-gi-se-gye license, which is a PC client game of Chengchi Games, but the court ruled that regardless of Chengchi Games' right to license Geon-gi-se-gye, the web game Geon-gi-se-gye and the Geum-jang-geon-gi violate the copyright of Yeol-hyeol-jeon-gi.

This is in line with the Singapore arbitration's ruling last month, which resulted in the violation of the The Legend of Mir2 Software License Agreement(SLA) contract, and the international arbitration standards and the judgment of the Beijing Intellectual Property Court can be seen as the intellectual property court.

According to the court ruling, both games must immediately stop game services, marketing, and operating activities, as well as discard all related materials.

Currently, Wemade is working on six lawsuits, including web games 'Jeon-gi-pye-eop', 'Do-ryong-pa-hyo', 'Hwang-geum-jae-gyeol' and 'Wang-seong-yeong-ung' with 37 Games. Among them, the court ruled in favor of Jeon-gi-pye-eop, Geum-jang-geon-gi and mobile game Jeon-gi-pye-eop.

Other copyright infringement games are also being tried in various courts in China, with the first and second trials, especially Jeon-gi-pye-eop is in the face of the Beijing court's final trial.
